Yeap! Was super surprised and based on how the incident is panning out, it looks like it was a corporation wide cover up...very strange. Totally not what I would expect.

As to why, clearly the performance (horsepower and torque) and the fuel mileage suffered significantly from engaging the emission control routines and hardware. VW has been promising and investing heavily on great performing diesels and very efficient mileage as selling points. But they couldn't meet emissions at the same time - it was a trade-off.

It's actually because of German ingenuity that they were able to do this for many years no? When the firmware detects the steering wheel is straight and the rear wheels aren't turning, the firmware switches to EPA mode.

What is more ingenious?

1.Doing more EGR when test mode is detected or

2. doing less EGR when conditions excluding bench usage are detected like GM does

Anyway aftermarket EGR delete kits have been available for years,so if 2.is illegal,then these kits should be banned too

Breaking news of a prematurely leaked report in Germany. A top secret study on 53models,conducted with the transport ministry since September 2015,will release results this week. All models were within limits in lab,but some exceeded limits in street driving without "defeat" software! Actually VW is the cleanest among Euro6 engines. Looks like all these models and others with same engine will be recalled in 2017 for improvements to emissions during real road driving conditions compared to lab.
